                   Stud Contract : CONDITIONS OF SERVICE

1.
a) Upon the signing of this agreement I do hereby swear that I am the owner of this bitch and have legal right to breed her. Further, I certify that this bitch is registered with The American Kennel Club.
b) I attest that this bitch is at least 22 months of age and less than 7 years of age at the time breeding takes place.
c.) I attest that I have the bitch's best welfare at interest and that I am able and capable of caring for this bitch if in whelp and for her litter. I will provide all necessities, including veterinary care, adequate feed, water, and shelter for the dam and puppies.
2.
a) Bitch owner does hereby swear that this bitch has not produced a litter of more than one live puppy within a 12 month period.
b) Further, the bitch owner attests that should a litter occur from this mating it will not result in the bitch owner producing over a total number of 8 (eight) litters produced within a 24 (twenty four) month period; owned or co-owned.

a) The owner of the bitch agrees to pay the stud dog owner a stud fee of --------------------- for services performed by the above mentioned male.
b) The stud fee will be due and payable upon placement of the first puppy; whether it be sold, given away, or otherwise placed.
c) Regardless of placement, the stud fee shall be due by the litter's 9th week of age.
e) The stud dog owner is not obligated to sign the litter registration papers on the litter until the stud fee has been paid in full; it shall be their option whether or not to do so before the stud fee is paid.
4.
a) If  3 puppies are born alive, this constitutes a litter. However, if only one puppy is born alive the stud dog owner shall settle for $750  stud fee, if 2 puppies are born alive the fee will be $1000.

b) The breeder understands it is their responsibility to ensure that all offspring resulting from this breeding is fully wormed and innoculated and should have complete veterinary exam before placement. Stud dog owner suggests complete physical, inoculations, blood work, and specific gravity on each puppy.
5.
a) The owner of the bitch hereby agrees to pay all expenses incurred for the purpose of this breeding at the time in which they are incurred. Including, but not limited to, all veterinary costs, artificial insemination, semen collection (fresh, chilled, or frozen), and shipping of the same.

a) In the case that the stud dog owner chooses a puppy in lieu of stud fee, then the stud dog owner shall have first pick of the litter before any puppy from this litter is promised. They shall choose this puppy on or before the litter reaches 8 weeks of age.
b) The stud dog owner has the right to use their kennel name upon the naming of this puppy and has the right to decide whether or not to use the breeder's kennel name.
c) Should the stud dog owner choose a puppy as stud fee; they have the right to either keep, sell, or place the puppy with a third party under a co~ownership or sole ownership agreement. Should they choose to sell the puppy, they shall give the breeder first option to purchase the puppy at the original stud fee agreement. if the puppy is placed with, in any way, a third party then the stud dog owner shall inform the breeder where the puppy is placed so the breeder can keep track of the dog.
7.
a) The bitch owner does hereby agree and make absolute promise that they will not transfer ownership, in any way, of any puppy resulting from this breeding to any person or organization whose intent is to resell, trade, or give away the puppy; or to use it in any laboratory experiments.
b) The bitch owner further agrees and does make absolute promise that they will not knowingly sell, trade, or give away a puppy resulting from this breeding to a known puppy mill or person whose sole intent is to breed and produce litters from the dog. But the puppies resulting from this breeding shall be placed into loving family homes who will care for the health and well~being of the puppy.
8.
a) The bitch owner (being the Breeder) agrees to keep track of every puppy from this litter and periodically check on the welfare of the dog.
b) The breeder also agrees to make known to the Stud dog owner where pups are placed and with whom for the stud dog owner's purpose of seeing what their stud has produced.
9.
a) The breeder (being the bitch owner) agrees to be responsible for the offspring of this breeding and further agrees to take back puppies and place them or assist  in placing them if the owner/s can no longer keep them. Bitch owner agrees, in no case, will they knowingly allow the puppies/dogs resulting from this breeding be allowed to be placed into a shelter or pound.
b) The stud dog owner agrees to help in the placement of these puppies should the breeder not be able to do so.
c) The stud dog owner further agrees to assist the breeder in the replacement of any offspring resulting from this breeding in the event that the owner can no longer keep the dog; or to take responsibility for the placement of the dog should the breeder be unable to do so.
a) Should the bitch owner fail to comply with the terms of this agreement, upon court awarding decision of "breach of contract", they agree to pay the stud owner $5000.00 (five thousand dollars) in liquidated damages for damages to the owner's kennel name and reputation. Also for time, trouble, mental duress and damage to the dog's reputation.

10.
I/We the undersigned, have thoroughly read and understand the contents of the entirety of this agreement and acknowledge this to be a true and binding contract. By the signing of this contract, I/We, do hereby agree and make absolute promise to abide by it's terms and conditions.
11.
As Mastiff breeders dedicated to the breed we recognize our responsibility to breed only the best specimens to compliment the betterment of the breed.

The following agreement is between __Cherry Hills Mastiffs__hereafter referred to as the "Breeder" and _____________________________________, hereafter referred to as the "Buyer" for the sale and purchase of one purebred dog of the English Mastiff breed.

This Purebred English Mastiff puppy will become the property of the Buyer upon transfer as well as the title upon fulfillment of the following conditions:
A. Purchase Price of                     will be paid by the Buyer to the Breeder. A non-refundable deposit of            has been placed to hold this English Mastiff puppy for the Buyer until time of transfer. The balance of the purchase price must be paid in full prior to transfer of the puppy or at the transfer of the puppy at 8 weeks of age. The balance of the purchase price may be paid in a lump sum at the time of transfer or Buyer may make installment payments while the puppy is in the Breeder’s care. If balance of purchase price is not paid then the deposit is forfeited and alternate arrangements will be made for the placement of the puppy.
B. Transportation costs, if any, will be paid by the Buyer.
 
It is further agreed upon that both parties:
A. Use of the English Mastiff puppy
It is agreed between the Breeder and the Buyer that the Mastiff puppy is going to become a family companion dog or for a working dog used for tasks appropriate for the Mastiff breed such as for Therapy, exhibition in AKC conformation, obedience, or agility competition.
B. Buyer agrees that the dog is not purchased for resale nor will it be used or trained for activities which are illegal or for which it is not suited by reason of temperament or conformation. Specifically, it will not be used as a guard or attack dog nor for hunting or fighting other animals.
The Buyer agrees that he/she will not sell, transfer ownership or possession of the puppy or any of his/her progeny to any person or organization whose intent is to resell (pet store), trade or give away the dog , or use it in any experiment, laboratory or otherwise. Buyer will not use the dog as breeding stock for any type of puppy mill.
 
C. Health of The Dog
The Breeder warrants the dog to be in excellent health at the time of transfer/purchase/pick-up. This Breeder does give a 2yr health warranty for major genetic abnormalities which is limited to only these following conditions : The contract only covers hip/elbow dysplasia which must be proven by a vet to be caused by genetic history/makeup, PRA caused and proven by a vet to be a result from genetic history/makeup.
This puppy is not guaranteed against:
a. Hypertrophic Osteodystrophy (H.O.D.)
b. Osteochondritis Dissecans (O.C.D.)
c. Panosteitis (Pano)
d. Any non-genetic disease
If puppy is proven by the Buyer’s veterinarian and the Breeder’s veterinarian to have one of these genetic issues (hip/elbow dysplasia or pra) then the health guarantee comes into place. This Genetic problem must be solely caused by genetics. If there is question on physical attributes that may contribute to problem then this breeder may visit the Buyer’s home at their convenience to see the dog’s living environment. After proven abnormality, then the Buyer has the option to keep the puppy/dog and receive a new choice puppy out of another litter with different parents or the Buyer may return the dog and receive a new puppy out of different parents. After the dog’s second birthday this contract is null and void. Though, for questions and concerns we are always willing and able to help you. It is the Buyers’ responsibility to prevent illness and injury by providing necessary booster vaccinations, veterinary care, nutrition, fresh water, shelter and supervision at all times. It is also the Buyers responsibility to accommodate the home of the Mastiff puppy/dog to suit it’s size and special needs.
It is recommended by the Breeder that the Buyer take the puppy to a Veterinarian of his/her choice and gives the Buyer 5 days in which to do so. If , within those 5 days, a veterinarian finds the puppy to be possessing a serious genetic defect, a statement in writing must be submitted to the Breeder from that particular Veterinarian to review. Upon conformation from the Breeders’ Veterinarian of said condition, Buyer may return the puppy, registration papers , and all of his/her personal effects given to Buyer at the time of Transfer back to the Breeder and receive a full refund of the total purchase price. All of said puppys' vet bills and return travel expenses incurred will be the responsibility of the buyer.
All Precautions have been made to insure that this puppy is in excellent health at the time of purchase/transfer including vaccinations at 6 weeks of age during a Veterinary wellness checkup and deworming on a regular basis. It is recommended that additional vaccinations be given at 8, 10, and 12 weeks old, with an annual booster immunizations. Additionally, male show dogs have been checked and verified by a veterinarian that both testicles have descended at the time of pick-up. Accidents can happen with new puppies, However, this contract does NOT cover testicle trauma after the puppy goes to his/her new home.
D. REGISTRATION
The Breeder certifies that the dog is eligible for registration under the Regulations of the American Kennel Club as a purebred English Mastiff and will provide the proper forms for registration.
E. OWNERSHIP RESPONSIBILITIES
The Buyer agrees to maintain the dog in a humane environment and properly train and care for it throughout his/her life. Specifically, the dog will be properly licensed and inoculated against rabies, distemper, parvovirus, and other communicable diseases as recommend by a qualified by veterinarian. The dog will not be allowed to roam and will be socialized with obedience training appropriately. The Breeder strongly recommends permanent identification by tattoo or microchip.
Buyer Also agrees that nothing will be given to the dog for rapid growth: including steroids, nutritional supplements, and anything that promotes rapid weight gain. A high quality, low protein adult formula dog food is recommended.
F. "SHOW QUALITY" DOGS
The Breeder will use her best judgment and the advice of other fanciers in evaluating the puppies as to show or for pet quality. There is NO guarantee that a puppy evaluated as "Show Quality" will be successful in the show ring as an adult and no warranties are made to that effect. The Breeder encourages owners to participate in the sport of purebred dogs and may be available to assist the Buyer in preparing and showing dogs, which are evaluated to be of show quality.
 
G. RIGHT OF RECOVERY/PLACEMENT
In the event that the Buyer is unable to keep the dog or provide an appropriate home in accordance with this agreement, the dog with it’s title/registration will not be transferred to any person or organization other than the Breeder, whether by sale, gift, loan, or otherwise, unless agreed to by the Breeder in writing. Buyer agrees to notify the Breeder if any such contingency should arise and will not abandon the dog to a shelter or sell/give the dog away. If the dog is found to have been sold or given away without Breeder knowledge and Breeder discovers this, Breeder will take legal action and the original Buyer of the dog will be responsible for all the legal expensed incurred.
This contract is to protect the Mastiff and it’s future offspring, the Breeder and the Buyer of said Mastiff puppy. By signing, all parities agree to all the clauses of this contract. This Contract must be signed and returned to me within 2 months of Transfer date of said puppy. If contract is not returned this Breeder will attempt to contact said Buyer at any cost over any given amount of time to ensure the puppy is still in Said Buyers’ possession. If said Buyer has not abided by this contract then the contract is null and void. If said puppy is in any way abused, neglected, or suffers from malnutrition this Breeder has right of recovery.
